A 10-year-old rape victim who was denied the right to an abortion by a court in India has given birth by caesarean-section in a Chandigarh hospital. According to her parents, the young girl had never been told that she was pregnant but rather that she had a “stone” in her stomach. The girl, who was allegedly raped by her uncle, reportedly does not know that she gave birth to a baby.
The parents of the girl had discovered the pregnancy after she complained of stomach pains, and later told them she had been raped by her uncle multiple times. The girl was denied the right to an abortion by a court after it was determined that she was six months pregnant and that the fetus was already viable, according to CBS. But many doctors disagreed vehemently with the ruling, noting that the physical and psychological risks of giving birth far outweighed the risks of having an abortion even at such a late stage.
Abortions after 20 weeks are banned in India, but exceptions can be made if a fetus is unviable or if the mother’s life is at risk. In a similar case earlier in India this year, a 10-year-old was allowed to have an abortion while 21 weeks pregnant after she was allegedly raped by her stepfather.
